The Meeting was called to order by V. I. Schelkunov.
V. I. Schelkunov presented the agenda which was unanimously adopted.
Concerning the first item of the agenda:
V. I. Voronoi (OCSP) provided the information about the course of the experiment concerning the introduction of electronic order in OCSP under the “Single Window – Local Decision” pilot project in the operations area of Pivdenna Customs House and Odessa Region ports. Told about the obstacles arising in the course of the “Single Window” technology commissioning, namely: port community low activity concerning connection to the system.
R. Ye. Sakhautdinov informed about the State Sanitary Service of Ukraine rejection to grant free pratique to large-tonnage container ships which service the direct container services along the route “ports of south-east Asia – the Black Sea ports”. And presented the results of “free pratique” introduction efficiency estimation.
RESOLVED:
1.1. Take note of the information of V. I. Voronoi, Chief of Service for Logistics and Commercial Work, the Odessa Commercial Sea Port (OCSP), about the course of experiment on commissioning the OCSP electronic order under the “Single Window – Local Solution” pilot project. Entrust OCSP with arranging for the above transfer and create the order in from of an electronic document before 1 February 2013.
1.2. Prepare the Application to the Ministry of Health of Ukraine for explanation of refusal of the State Sanitary Service of Ukraine to grant “free pratique” to the large-capacity container ships of OCSP which are servicing direct container carriage along the route “ports of south-east Asia – the Black Sea ports”.
Concerning the second item of the agenda:
Master Action Plan of implementation of the “Single Window – Local Solution” pilot project in the Odessa Commercial Sea Port.
V. I. Voronoi presented the Master Action Plan of commissioning the “Single Window – Local Solution” pilot project in the Odessa Commercial Sea Port, the data harmonization process and creation of the data library.
M. Apostolov provided his comments and proposals as to Master Action Plan. (See Annex # 3).
RESOLVED:
2. Note the Master Action Plan of commissioning the “Single Window – Local Solution” pilot project.
Concerning the third item of the agenda:
Information of the Ministry of Infrastructure of Ukraine on preparing the draft standard acts, namely:
R. V. Kogut informed the sitters of the Meeting about working over the above mentioned draft standard acts.
RESOLVED:
• Draft Resolution of the Cabinet of Ministers of Ukraine “On Amendments to Resolution of Cabinet of Ministers of Ukraine dated 21 May 2012 # 451 ‘Issues of Passing through State Border of Persons, Motor, Water, Railway and Air Transportation Vehicles of Carriers and Cargoes which are Transported by them’”;
• Draft Order of the Ministry of Infrastructure of Ukraine “On Amendments to Rules of Issuing Cargo Transportation Documents for Transportation by Sea” approved by Order of the Ministry of Transport and Communication of Ukraine dated 13 December 2004 # 1098 on changes in the composition of the Interagency Working and Expert Groups for implementation of the “Single Window – Local Solution” technology in the operations area of Pivdenna Customs House and Odessa Region ports.
Concerning the fourth item of the agenda:
Discussing the basic documents for implementation of the pilot project in OCSP:
O. Platonov presented the drafts of the above mentioned documents to the Meeting sitters for consideration. Those present expressed their remarks and proposals concerning the text of the Draft Resolution of CMU.
P. V. Pashko supported the urgency of “Single Window” commissioning, but noted that the work of the Interagency Working Group must be organized on a high level and all procedures and functions of the Working and Expert Groups must be described in detail.
O. Ye. Moshynska dwelled on a number of remarks made by the State Customs Service of Ukraine as to the Draft Resolution text (editor’s, textual, etc.) and also stated that the Draft Resolution provides for authorities of the State Customs Service of Ukraine and its leaders which are not provided by the Provision on the State Customs Service of Ukraine approved by Decree of the President of Ukraine dated 12 May 2011 # 582/2011.
O. Ye. Moshynska noted the fact that the documents are submitted to the Members of the Interagency Working and Expert Groups for consideration on a very tight time schedule which is insufficient for their study and thrashing out and also proposed that the draft standard and legal documents should be worked over by a group of experts before their submission to the Interagency Working Group for consideration: that will enable discussing of only uncoordinated issues and deal with no editing.
O. M. Tverdokhlib noted that the Members of the Interagency Working Group are not authorized to endorse draft resolutions, so, he proposed to strike the item on endorsement of the CMU Draft Resolution “On Organisation of Interagency Working Group for ‘Single Window – Local Solution’” off the draft decisions and also proposed to cancel the words “and endorsement” in Item 4, CMU Draft Resolution “On Organisation of Interagency Working Group for Implementation of the “Single Window – Local Solution” Technology.
S. B. Kotov noticed that the submitted Draft Resolution may not be considered at the Meeting due to incompliance of some provisions with the requirements of the legislation of Ukraine concerning the border issues and proposed to narrow the Draft Resolution so that it only concerns “Single Window”.
O. I. Platonov paid attention to the fact that based on the results of the International Seminar on trade facilitation, UNECE, it was recommended to commission the “Single Window” technology in all checkpoints, but as the budget was empty it was decides to commence the project from the ports of Odessa Region with its further extension to other ports and checkpoints at the state border. That is why the project includes the title “On Organisation of Interagency Working Group for Commissioning “Single Window – Local Solution” Technology. O. I. Platonov also explained that proposed in the Draft Resolution are the names of ministers and authorities, but not the titles which was done for more fast and efficient work of the Interagency Working Group. He agreed with O. Ye. Moshynska’s position as to organizing the work of the expert groups for preliminary working over the draft standard and legal acts for the purpose of speeding up the work of the Interagency Working Group and with O. M. Tverdokhlib’s proposals.
O. I. Platonov also proposed to recommend the representatives of SMSU to make amendments to CMU Resolution dated 21.03.2012 # 219 “On Approval of Criteria Used in Estimating the Degree of Risk from Customs Broker’s Activity and in Determining Periodicity of Planned State Supervision (Control)” in order to provide for the procedure of EDS issuance to the control bodies’ representatives involved in the customs clearance and control procedures.
The discussion was joined by:

O. I. Platonov proposed to make all the comments in writing and send them to Secretariat.
RESOLVED:
4.1. Recommend the Ministry of Economic Development and Trade of Ukraine to present for consideration to the Cabinet of Ministers of Ukraine Draft Resolution of the Cabinet of Ministers of Ukraine “On Organisation of Interagency Working Group for Commissioning the “Single Window – Local Solution” Project in accordance with the requirements of the rule-making technique determined by the Regulations of the Cabinet of Ministers of Ukraine and approved by Resolution of the Cabinet of Ministers of Ukraine dated 18.07.2007 # 950.
4.2. Note the information on the draft basic documents pertaining to the commissioning of the pilot project in OCSP:
• Draft Statute of Port Community Association;
• Draft Statute of the Project Direct Financing Fund;
4.3. Note the information of O. I. Platonov, Deputy Leader of the Interagency Working Group on concluding a cooperation agreement between JSC PLSKE, LLC PPL 33-35, SE “Illichivsk Commercial Sea Port” (ICSP) and PE “Container Terminal Illichivsk” for the purpose of implementing a special programme product in ICSP under the Unified Information System of Port Community.
Concerning the fifth item of the agenda:
