The Meeting was opened by V. I. Schelkunov.

V. I. Schelkunov announced the agenda which was adopted unanimously.

Concerning the first item of the agenda:

Information of the Interagency Working and Expert Groups on implementing the project “Single Window – Local Solution”

 

V. I. Schelkunov informed those present about the working meeting with O. Yu. Vilkul, Vice-President of Ukraine, where the project of commissioning «Single Window – Local Solution” technology and results of the work of the Interagency Working Group were presented. Besides, stated was the information on other working meetings relating to the introduction of the pilot project.

V. I. Voronoi (SE OCSP) gave the information about the Port’s work on commissioning the technology of the “Single Window – Local Solution” pilot project (see Annex # 3). The reporter swelled on the obstacles arising in the course of the project commissioning, namely: participants’ low activity and absence of full-fledged standard base for the project commissioning.

V. I. Voronoi reminded those present that in accordance with the resolution of the Interagency Working and Expert Groups meeting dated 20.12.2012 the Members of the Groups had to submit proposals as to the Table of Terms and arrange for organization of the Targeted Expert Groups before 10.02.2013. Such proposals have not arrived. It was proposed to all Members of the Interagency Working and Expert Groups to suggest candidacies for the legislation optimization, processes research, data harmonization and investment processes expert groups before 12.03.2013 and the candidacies being absent approve the following composition of the expert groups:

- EG for legislation optimisation: R. V. Kogut (the Ministry of Infrastructure of Ukraine), O. V. Orlov (LLC PPL 33-35) and O. Ye. Moshynska (SMSU);

- EG for processes research: O. P. Babikov (SE OCSP), A. V. Shevchuk (LLC PPL 33-35);

- EG for data harmonisation: P. V. Pashko (SMSU), D. O. Yakimenkov (SE OCSP);

- EG for investments: O. I. Platonov (Association UKRZOVNISHTRANS), representative of the Ministry of Economic Development and Trade.

O. Yu. Yemelianova nominated O. O. Kordina, Chief of the Authority for State-Private Partnership and State Guarantees, the Ministry of Economic Development and Trade of Ukraine, to the EG for investments.

V. I. Voronoi informed the audience about additional amendments to Resolution of CMU dated 21.05.2012 # 451 which enables the control bodies to obtain EDS for free.

V. I. Voronoi also noted that in connection with implementation of Order of the Ministry of Justice of Ukraine # 1236/5/453 dated 20.08.2012 and suspension of accreditation of ACKC SMSU from 01.02.2013 there arose irregularities in the EDS keys operation. Partially due to the fact that various ACKC were transferring to the new key format in different time, in the course of a period from 10 to 19 January the keys of ACKC IOK were actually not serviced and from 19.01.2013 the have been services with breaks for synchronisation. The key of ACKC DBS of Ukraine became accessible since 08.02.2013 and today we expect that the issuance of EDS to the actors of the transportation process and representatives of state control bodies will be started.

V. I. Voronoi proposed to recommend the State Customs Service of Ukraine to organize the EDS keys issuance for free with the help of its own ACKC and supply them to all participants of the transportation process and representatives of control bodies and provide for the EDS keys servicing without interruption.

I. L. Romanov, Director of Information and Inquiries Department, the State Tax Service of Ukraine, informed those that the said problem has been settled: the State Tax Service of Ukraine have opened 104 registration points for issuing keys, five of them in Odessa, and STSU is ready to ensure the regular operation of ACKC and free issuance of the EDS keys to control bodies.

V. I. Voronoi also stressed the requirement to coordinate the following issues relating to the Draft Order of the Ministry of Finance of Ukraine “On Approval of Customs Formalities Procedure when Conducting Customs Control and Customs Clearance of Water Transportation Vehicles of Carriers and Goods which are Transported by them”:

- correspondence to the document of the “Single Window” concept;

- correspondence of the terms to the adopted Law of Ukraine “On Sea Ports”;

- determination of the format and procedure of preliminary information transfer by linear agents; and

- exchange of information between UIS and customs bodies, etc.

V. I. Voronoi proposed to call before 10.04.2013 the Expert Group field meeting to work on the details of the coordinated version of Order of the Ministry of Finance of Ukraine “On Approval of Customs Formalities Procedure when Conducting Customs Control and customs clearance of Water Transportation Vehicles of Carriers and Goods which are Transported by them”, coordinate integration of control bodies in UIS, exchange the risk analysis information between UIS and UAIS and coordinate terminology used in the standard documents. Determine the place of the Meeting in Odessa where it is possible to familiarize with LLC PPL 33-35, provider of UIS, work.

O. Ye. Moshynska informed the participants of the meeting about the consideration procedure of the said draft Order of the Ministry of Finance of Ukraine and mentioned that the consideration of the draft project will require more time.

V. V. Zakolodiazhnyi, Deputy Director of the Department for Customs Control and Clearance Organisation, SMSU, remarked that SMSU’s activity is exclusively guided by the legislative and other normative legal acts and, besides, standards of the orders may not contradict the same of the higher level. Thus, the draft Order of the Ministry of Finance of Ukraine must be considered with a glance at the standards of Resolution of the Ministry of Finance of Ukraine# 451.

V. V. Zakolodiazhnyi observed that the State Customs Service of Ukraine supported amendment of Resolution of the Ministry of Finance of Ukraine # 451 in the near future. At the same time, the introduction in Resolution of CMU dated 21.05.2012 # 451 additional changes proposed by V. I. Voronoi is inexpedient as that will delay the process of adoption of already coordinated and agreed amendments to Resolution of CMU # 451 (concerning UIS).

V. I. Voronoi returned that the draft order includes many other issues which are not connected with the amendments to Resolution of CMU # 451.

O. I. Platonov turned attention of those present to the fact that Secretary of the Interagency Working Group will prepare a report on the research carried out within the framework of "Single Window – Local Solution” technology for the purpose of identifying bottlenecks which will be directed to this country leaders. The analysis of the project commissioning showed that linear agents do not submit the required cargoes information to the customs bodies and that causes the customs bodies to delay goods clearance. Transparency on the side of all parties is needed, both from business players and state control bodies which is the project commissioning task, too.

He also observed that soon it will be eight months during which the documents (draft amendments to Resolution # 451 and others) have been considered, and this makes any advance of the latest technologies commissioning and increase of competitiveness and investment appeal of this country impossible. And the project “Single Window – Local Solution” is one of the instruments of this process. Given all that, O. I. Platonov called all members of the Interagency Working and Expert Groups to fruitful cooperation.

V. I. Voronoi informed about the proposals of linear agencies relating to the possibility of submitting information to UIS in alternative formats.

O. M. Ivashkovych informed that in compliance with the requirements of the standing legislation (Resolution of CMU # 733 dated 17.07.2009 and Order of the Ministry of Education# 1207 dated 20.10.2011) the format which is used in electron exchange of information between the executive bodies is the format XML. The procedure of converting the data in different formats is determined by the Format and Procedure of Information Exchange approved by SMSU and Administration of OCSP.

M. Apostolov, Regional Adviser of EEC UN for Trade Issues, had prepared an analysis of the project commissioning stage and give his recommendations as to the following steps (see Annex # 4), in particular concerning further preparation of the project commissioning Master Plan and data harmonisation. M. Apostolov proposed that the Working Group should make up the Ukrainian trade facilitation strategy including further development of such projects as “Single Window – Local Solution” irrespective of political changes in the country; organize a corresponding group of experts within the framework of the Working Group and the structure and main sections of such strategy; and include the identified correspondences with the international classifiers and codes in the data harmonization tables.

 

RESOLVED:

  1. Include O. V. Orlov, Executive Director of the Service Centre, LLC PPL 33-35, in the Interagency Working Group.
  2. The Members of the Interagency Working and Expert Groups should, at will, provide the candidates to be the members of expert groups (EG) for legislation optimization, processes research and investments processes.
  3. Should the candidates be absent, approve the following composition of expert groups:

- EG: R. V. (Ministry of Infrastructure of Ukraine), O. V. Orlov (LLC PPL 33-35) andO. Ye. Moshynska (SMSU);

- EG for processes research: O. P. Babikov (SE OCSP) and A. V. Shevchuk (LLC PPL 33-35);

- EG for data harmonisation: P. V. Pashko (SMSU) and D. O. Yakimenkov (SE OCSP);

- EG for investments: O. I. Platonov (Association UKRZOVNISHTRANS) andO. O. Kordina (by approval of the Ministry of Economic Development and Trade).

1.4. Coordinate additional amendments to Resolution of CMU dated 21.05.2012 # 451.

1.5. Before 10.04.2013 in Odessa hold a field meeting of the Expert Group for Legislation optimisation (with participation of other wishing parties) for the purpose of working on the coordinated version of Order of Ministry of Finance of Ukraine “On Approval of Customs Formalities Procedure for Conducting Customs Control and Customs Clearance of Water Transportation Vehicles of Carriers and Goods which are Transported by them”, coordinating the issues of the control bodies integration in UIS, exchange of risk analysis information between UIS and UAIS and coordination of terminology used in standard documents.

1.7. The Service Centre of LLC PPL 33-35 must consider the possibilities of development and certification of additional information protection modules which enable to convert the UIS electronic documents in the approved format into the documents in alternative formats in bursting (automatic) mode in accordance with the requirements of the standing legislation of Ukraine on the side of users and players of UIS.

Concerning the second point of the agenda:

Discussing the programme of the Third International Seminar of EEC UN on the issues of trade facilitation and local “Single Window” (as attached hereto) and the Ninth Meeting of the Interagency Working and Expert Groups on commission the “Single Window – Local Solution” technology in the Operations Area of Pivdenna Customs House and Odessa Region Ports within the framework of the International Seminar.

 

            O. I. Platonov informed the sitters of the Meeting about the Third International Seminary of EEC UN on trade facilitation issues which is planned to be held on 30 May 2013 within the framework of the International Transport Week in Odessa (see Annex # 5) and proposed to hold a field meeting of the Interagency Working and Expert Groups on commissioning of technology “Single Window – Local Solution” in the Operations Area of Pivdenna Customs House and Odessa Region Ports which will take place at the time of the Third International Seminar organized by EEC UN under the auspices of the Government of Ukraine.

            M. Apostolov, Regional Adviser of EEC UN, presented the main items of the agenda of the EEC UN Seminar: Master Plan of the “Single Window – Local Solution” project, its importance and benefits of its introduction for various agencies and private business.

 

RESOLVED:

  1. Hold the next Meeting of the Interagency Working and Expert Groups for discussing the commissioning of “Single Window – Local Solution” technology in the Operations Area of Pivdenna Customs House and Odessa Region Ports on 30 May 2013 in Odessa within the framework of the EEC UN Third International Seminar.
  2. Address the Prime-Minister of Ukraine with a request to entrust ministers and other central executive bodies with a task to direct the Members of the Interagency Working and Expert Groups for commissioning of “Single Window – Local Solution” technology in the Operations Area of Pivdenna Customs House and Odessa Region Ports to take part in the Meeting in Odessa that will take place on 30 May 2013.
